These Terms and Conditions (the "Terms") govern your use of the Excell Catering Equipment website (excellcat.com) and the supply of catering equipment, accessories and related services (collectively, the "Services") by Excell Catering Equipment (Pty) Ltd ("Excell", "we", "our" or "us"). By placing an order or requesting a quote you accept these Terms.
1. Quotes and orders
Quotes are valid for 14 days from issue date unless otherwise stated, and are subject to stock availability. Prices exclude VAT, delivery and installation unless explicitly noted. Orders are accepted in writing (e-mail, signed quote acceptance or via this website).
2. Payment terms
Unless an account has been opened with Excell on approved terms, full payment is required before dispatch. Approved account customers are billed on standard 30-day terms. Late payments accrue interest at the prevailing prime rate plus 2% per annum.
3. Delivery
Delivery times are estimates and are subject to stock, courier capacity and uncontrollable delays. Risk passes to you on delivery. Title remains with Excell until the invoice has been paid in full.
4. Returns
Defective goods reported within 7 days of receipt may be returned for repair, replacement or refund at Excell s discretion. Special-order, configured or installed items are non-returnable. Returns must be in original packaging.
5. Warranties
Manufacturer warranties apply per product and are stated on each product page. Excell will assist with warranty claims but ultimate liability rests with the manufacturer. Warranties do not cover wear-and-tear, abuse, unauthorised modification, incorrect installation, or use of non-approved consumables.
6. Installation and after-sales
Installation, where included, will be performed by Excell-approved technicians. The customer is responsible for site readiness (electricity, ventilation, plumbing, access). Out-of-area installations may attract additional travel and accommodation costs.
7. Privacy
Personal information is processed in accordance with our Privacy Policy, which complies with the Protection of Personal Information Act, 2013 (POPIA).
8. Limitation of liability
To the maximum extent permitted by law, Excell is not liable for indirect, incidental or consequential loss, including loss of profits, business interruption, or spoiled stock. Our maximum aggregate liability for any single claim is limited to the value of the goods supplied.
9. Governing law
These Terms are governed by South African law and any dispute will be subject to the jurisdiction of the Magistrate s Court for the district of Kimberley.
